This policy covers: movmenta.com (Website) and the SOLLO mobile application (App)

We are committed to ensuring that your privacy is protected. This policy (together with our terms of use and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

This policy applies to two distinct contexts: (1) your use of our website at www.movmenta.com; and (2) your use of the SOLLO mobile application (“the App”) available on Android and iOS. Where provisions apply only to the website or only to the App, this is made clear in the relevant section.

Movmenta Limited is a Data Controller within the meaning of the General Data Protection Regulations (GDPR). We are a Limited Company from premises located at Suite 5 10 Churchill Square Kings Hill ME194YU United Kingdom.

This Privacy Statement sets out the basis upon which any personal data that we collect from you or that you provide to us via this website. To understand how this Privacy Statement applies to you personally, you may also need to refer to any personal communications you have received from us, check any privacy notices that we have provided.

Movmenta Limited is committed to maintaining full compliance with the requirements of the GDPR. These Regulations are designed to ensure that any personal data that we process is stored securely, is accurate, and is processed fairly, lawfully and transparently, and that we protect the rights of any data subject. The GDPR also grants a number of rights to data subjects, which are described below.

This app is not a medical device and does not diagnose, treat, or prevent any condition. SOLLO is a footwear tracking and performance monitoring tool intended for general consumer use only.

Part 1 – Website (www.movmenta.com)

The following sections apply to your use of our website at www.movmenta.com.

Information we may collect from you (Website)

We may collect and process the following data about you:

  • Information you give us. You may give us information about you by filling in The Contact details in our site www.movmenta.com (our site) or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you register to use our site, subscribe to our service, search for a service, enter a promotion or survey, or during the course of other activities commonly carried out on our site including when you report a problem. The information you give us may include your name, address, e-mail address and phone number and other information relating to your reason to interact with us via our website.

  • Information we collect about you. With regard to each of your visits to our site we may automatically collect the following information:

    • technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

    • information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number;

    • information we receive from other sources. We may receive information about you if you use any of the other websites we operate or the other services we provide. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies, online payment partners) and may receive information about you from them.

Uses made of the personal data (Website)

We may use personal data held about you in the following ways:

  • to carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us;

We may combine information that we receive from other sources with that information you give to us and information we collect about you. We may use this information and the combined information for the purposes set out above (depending on the types of information we receive).

Disclosure of your information (Website)

We may share your information with selected third parties including Analytics and search engine providers that assist us in the improvement and optimisation of our site. We may disclose your personal information to third parties:

  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of Movmenta, our clients, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Where we store your personal data (Website)

All information you provide to us is stored on our secure servers. We will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Part 2 – SOLLO Mobile Application (App)

The following sections apply specifically to your use of the SOLLO mobile application, available on Android (Google Play) and iOS (Apple App Store). The App operates independently from the website and collects different categories of data to provide its footwear tracking and performance monitoring functionality.

Information collected by the App

When using the SOLLO application, we may collect information necessary to provide the service, including:

  • account information;

  • device and application information;

  • shoe identifiers associated with your account;

  • NFC identifiers used to identify a specific pair of shoes;

  • information relating to runs associated with your shoes;

  • SOLLO sensor measurements, including measurements relating to cushioning degradation, stiffness and compression characteristics;

  • aggregated information about the usage and mechanical condition of a shoe over its lifetime.

This information is used to allow users to track and understand the condition and accumulated wear of their footwear.

Health and Fitness Data (App)

SOLLO can optionally connect to health and fitness platforms on your device so that you can import running and exercise information instead of entering it manually. This functionality is available on both Android and iOS, through the respective platform services described below.

Access to health and fitness data is always optional and only occurs after you have explicitly granted SOLLO the relevant permissions on your device. You can withdraw these permissions at any time through your device settings.

Android – Health Connect

On Android devices, SOLLO can connect to Health Connect by Android. Depending on the permissions granted and the data available in Health Connect, SOLLO may access the following fitness and exercise data:

  • exercise or running sessions;

  • activity start and end times;

  • activity duration;

  • distance;

  • elevation gain;

  • route or location information associated with an exercise session, where available and authorised by the user.

SOLLO requests only the Health Connect permissions necessary to provide its running and footwear tracking functionality.

iOS – Apple Health (HealthKit)

On iOS devices, SOLLO can connect to Apple Health via the HealthKit framework. Depending on the permissions granted, SOLLO may access the following fitness and exercise data:

  • workout sessions and exercise records;

  • running distance and pace;

  • active energy and step count;

  • elevation ascended;

  • workout route or GPS data associated with a session, where available and authorised by the user.

SOLLO requests only the HealthKit permissions necessary to provide its running and footwear tracking functionality. In accordance with Apple’s guidelines, HealthKit data is never used for advertising, marketing, or any purpose unrelated to health and footwear management. HealthKit data is not shared with third parties for advertising or data-mining purposes, and is not stored in iCloud.

How Health and Fitness Data is Used (App)

Health and fitness data accessed through Health Connect (Android) or HealthKit (iOS) is used only to provide and improve SOLLO’s user-facing footwear tracking functionality. The same principles apply on both platforms:

  • allow the user to identify and select a run;

  • avoid requiring the user to manually enter run information;

  • associate a selected run with a specific pair of SOLLO-enabled shoes;

  • add the distance of a run to the cumulative distance of that shoe;

  • add elevation information to the accumulated usage history of that shoe;

  • analyse how usage conditions affect cushioning and mechanical wear;

  • use the date, time and start location of an activity to determine environmental conditions relevant to footwear wear modelling;

  • display route information to help the user identify an activity.

Health and fitness data is not used for advertising, marketing profiling, credit assessment, insurance decisions or the sale of personal information on either platform.

SOLLO does not use health or fitness data to provide medical diagnoses or medical treatment.

We do not sell health or fitness data collected through Health Connect or HealthKit.

Part 3 – General Provisions (Website and App)

The following provisions apply to both the website and the SOLLO App.

Transfer outside of the European Economic Area

It may sometimes be necessary to transfer personal data overseas, normally for secure storage in the Cloud, when storage servers may be located outside the European Union (EU) and the European Economic Area (EEA). When this is required, any transfers of personal data overseas will be made in full compliance with the GDPR, and we have put in place safeguards to ensure that personal data is stored securely in the event that it is transferred outside the United Kingdom.

Data Retention Policy

We retain personal data for as long as is necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.

In particular:

  • Website data: account and contact information collected via the website is retained for the duration of your relationship with us and for up to 3 years thereafter, unless a longer period is required by law.

  • App account and sensor data: SOLLO sensor and shoe usage data is retained for the duration of your App account. Upon account deletion, we will delete or anonymise this data within 90 days, except where retention is required for legal, fraud prevention or security purposes.

  • Health and fitness data (Android – Health Connect and iOS – HealthKit): accessed in real time or near real time to provide the SOLLO service. We do not store raw health or fitness data beyond what is required to display your run history and shoe usage statistics within the App. Aggregated and derived shoe usage metrics may be retained for the lifetime of the associated shoe account. HealthKit data is not stored in iCloud.

  • Website analytics data (e.g. cookies, IP address logs): retained for up to 13 months in line with standard analytics practices.

You may request deletion of your personal data at any time by contacting us at contact@movmenta.com. Where deletion is not immediately possible (for example, because the data is stored in backup systems), we will ensure that the data is isolated and protected from any further processing until deletion is possible.

If you have a SOLLO App account and request account deletion, we will delete all associated user data within 90 days of your request, except where retention is required for legitimate purposes such as security, fraud prevention, or regulatory compliance.

Your rights

Under GDPR, you have the following rights in respect of personal data held by us:

  • the right of Access, in the event that you wish to know what personal data we hold on your behalf

  • the right of Rectification, in the event that the personal data we hold on your behalf is inaccurate

  • the right of Erasure, in the event that you wish us to destroy personal data held by us on your behalf

  • the right of Data Portability, in the event that you wish to transfer your personal data elsewhere

You have the right to ask us not to process your personal data for marketing purposes. We will never disclose your information to any third party for such purposes. You can exercise your right to prevent such processing at any time by contacting us at contact@movmenta.com

The rights listed above are not exhaustive – GDPR gives you a number of other rights, but those listed above are likely to be of most interest to data subjects. For further information about your rights under GDPR, please contact our Privacy Team on contact@movmenta.com

Our site may, from time to time, contain links to and from the websites of other networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites. This includes the individual franchisees with whom you are likely to contract.
